These Terms govern your use of BRASKOSCALEZ Journal at braskoscalez.com (the “Service”), operated by Maxime James (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is, and is not
The Service lets you record, import, organise, review and analyse your own trading activity. It is not a broker, dealer, investment adviser, portfolio manager or trade copier. It does not execute, route, modify or cancel orders, does not hold funds, and does not recommend any security, futures contract or strategy. Nothing in the Service is investment, financial, tax or legal advice. Read our Risk Disclaimer.
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract.
- Provide accurate information and keep your password confidential. You are responsible for activity under your account.
- Tell us promptly at contact.braskoscalez@gmail.com if you believe your account has been compromised.
- Demo sandboxes are temporary, contain fictional data and may be deleted at any time.
3. Your data
You keep all rights to the trades, notes, files and other content you put into the Service (“Your Data”). You give us a limited permission to store, process and display Your Data solely to provide the Service to you. We do not sell Your Data. You can export your trades and delete your account at any time from Settings.
Calculations (such as P&L, win rate, R-multiples, drawdowns and account balances) depend on the data you or your connected providers supply and may be incomplete or inaccurate. Your broker or prop firm's own records are the authoritative source for your accounts, balances, rule compliance and payouts.
4. Connecting brokers and platforms
- Connecting a provider is optional. You confirm that you are authorised to access each account you connect and to grant us read-only access to it.
- Connections are used only to read account and trading information. We never place, modify or cancel orders.
- Your use of each provider remains subject to that provider's own terms, fees and API conditions (for example, any API subscription it requires). We are not responsible for providers' availability, data accuracy or changes to their services.
- Synchronisation may be delayed, incomplete or interrupted. You can disconnect a provider at any time; this deletes its stored credentials.
5. Acceptable use
You agree not to:
- access another person's account or data, or connect accounts you are not authorised to use;
- probe, scan or test the Service's security, or interfere with its operation;
- upload malware or content you have no right to share;
- scrape, resell or create a competing service from the Service;
- use the Service in breach of any law, or of your broker's or prop firm's rules.
6. Fees
The Service is currently provided free of charge. If we introduce paid plans, we will tell you the price and terms in advance, and you will not be charged unless you choose a paid plan.
7. Availability and changes
We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation. We may improve, change or discontinue features. If we decide to end the Service, we will give you reasonable notice so you can export your data.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaches these Terms, or where required by law, and will tell you why unless prohibited from doing so.
9. Liability
Trading decisions are yours alone. To the extent permitted by applicable law, we are not liable for trading losses, missed opportunities, prop-firm account failures, or decisions made using information shown in the Service, nor for indirect or consequential damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for our own intentional or gross fault and your rights under Quebec's Consumer Protection Act.
10. Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the app at least 30 days before they take effect, describing the change. If you do not accept the new Terms, you may close your account before they take effect.
11. Governing law and disputes
These Terms are governed by the laws of the Province of Quebec, Canada and the federal laws of Canada that apply there. Disputes will be heard by the competent courts of Quebec, without prejudice to any right you have as a consumer to bring proceedings before the courts of your place of residence. Nothing in these Terms requires you to submit to arbitration or waives your right to participate in a class action.
